Sales Contract & Policy

Sales & Reservation Policy​

Davenport Hollow sells animals on a limited, first-come-first-served basis, unless otherwise arranged through a paid reservation or waitlist. 

  • Placement on any waitlist requires a non-refundable, non-transferable fee, with priority determined by the date payment is received. 

  • All animals must be paid in full before leaving our property

  • A non-refundable deposit is required to hold any animal. Deposits vary by species and will be discussed at the time of reservation. 

  • For in-person payments, the buyer must complete payment within 24 hours of agreement. Failure to appear at the agreed pickup time will result in the animal being relisted and the deposit forfeited. 

  • Remaining payments are due 1 week prior to transport departure. 

Accepted forms of payment include Cash, Paypal, Venmo, Cashapp or Zelle. We do not accept Checks at this time.

Because of limited cell service at our farm, all balances must be settled prior to pick up to avoid delays unless paying in cash at pick up.

All animals will remain in our care until at least 8 weeks of age. If the buyer does not pick up the animal within 14 days after the scheduled release date, a boarding fee of $15 per day will be charged. If unpaid boarding fees extend beyond 30 days, the buyer forfeits all payments and the animal may be resold.

We reserve the right to refuse or cancel any sale, at any stage, if we determine it to be in the best interest of the animal, our herd health, or our farm's reputation. Any refunds will be issued at our discretion, less any care or boarding costs accrued.

Animals won through auctions or raffles are final sale. No refunds will be given, and such animals remain subject to our first right of refusal.

First Right of Refusal​

All animals sold or rehomed from Davenport Hollow, whether bred by us or acquired from us, are subject to a First Right of Refusal contract.

​

If you are unable to keep an animal, you are legally obligated to offer it back to us before selling, transferring, or rehoming it. This policy is in place regardless of ownership duration or reason for surrender.

  • The return price shall not exceed the original purchase price.

  • Breeding fees are non-refundable unless the animal is returned prior to its due date.

  • Additional expenditures (showing, training, transport, veterinary, etc.) are not reimbursed.

  • Transportation is the sole responsibility of the seller unless otherwise arranged.

Returns must take place at Eutawville, SC, unless originally delivered by transport, in which case a similiar arrangement will be made.

​

Once an animal is returned, we are not obligated to offer it back to the original buyer in the future or disclose its next placement.

​

Violation of this clause may result in permanent ban from future purchases and legal action for breach of contract.

Transport Policy​

Rabbits do not require a Certificate of Veterinary Inspection (CVI) unless explicitly required by the chosen transport company. If a CVI is required, the buyer is responsible for all related costs. 

All other animals traveling by transport must have a CVI issued by a licensed veterinarian within 7 days of departure.

  • The buyer is responsible for arranging transport, covering CVI fees, and notifying us of timelines so we can coordinate vet appoints. 

  • The CVI and final payment must be completed at least 7 days before pickup. 

​

We only release animals to transporters we trust. The transporter's approval at pick up is the buyer's confirmation that the animal was healthy and fit for travel at hand off. 

  • We will provide clear photos and videos of each animal before pickup to verify gender, health, and clean condition. 

  • By proceeding after reviewing this media, the buyer accepts full responsibility for the animal from that point forward. 

Failure to meet or accept delivery as scheduled will result in forfeiture of the animal and all monies paid.

Health Guarantee​

To qualify for our limited health guarantee, the buyer must have the animal examined by a licensed veterinarian within 38 hours of receiving it, and must send us the veterinary report immediately after the appointment. 

This guarantee does not apply to rabbits, poultry or goats; rabbit, poultry and goat sales are final once they leave our care or are accepted by a transporter.

Our guarantee also does not cover:​

  • Communicable diseases or parasites (including but not limited to worms, coccidia, parvo, giardia, kennel cough)

  • Minor or manageable conditions not impacting long-term quality of life (such as undescended testicles, inverted vulvas, umbilical hernias, entropion, over/underbites, or microchip migration)

  • Temperament, size, color, markings, conformation, hunting or breeding abilities. ​

 

Replacement Policy:

If a major congenital or hereditary defect is diagnosed within two years, a replacement animal may be offered, provided all of the following conditions are met:

  • The animal has not been bred, spayed, or neutered (dogs under 24 months)

  • The animal was raised on an approved diet:

    • Dogs: 4Health Salmon & Potato

  • Veterinary records confirm appropriate care, vaccinations, and no signs of abuse, neglect, injury, obesity, or improper exercise

  • A signed report is submitted directly from the veterinarian

  • The animal has not been shown or used in high-impact activities

  • The guarantee is valid only to the original purchaser and is non-transferable

  • Replacement animals will be offered as available. If the replacement has a higher price, the buyer pays the difference. No refund is given if the replacement is of lesser value.

  • Replacements are offered "as-is" and come with no further guarantees

Any breach of the above voids the agreement. Abuse, neglect, or failure to meet any listed conditions will forfeit the replacement offer. The guarantee has no cash value.

Buyer Responsibility, Assumption of risk & Legal Liability 

​

  • The buyer affirms they are atleast 18 years old and legally capable of entering into this agreement. 

  • By purchasing an animal from Davenport Hollow, the buyer acknowledges and accepts all risk associated with ownership, including health issues, injury, or loss, and releases Davenport Hollow from liability for any damages after the animal leaves our care. 

  • It is the buyer's sole responsibility to maintain proper health care, vaccinations, parasite control, and secure housing after purchase. Davenport Hollow does not guarantee that an animal will remain disease - or parasite free after transfer. 

  • Under no circumstances will Davenport Hollow's liability exceed the original purchase price of the animal. We are not responsible for veterinary costs, emotional distress, or incidental damages.

 

Non-Disparagement & Dispute Resolution

​

  • Both parties agree not to publicly disparage, defame, or otherwise speak negatively about one another regarding this agreement, and not to make false claims, disparage, defame, or otherwise speak negatively about the animal(s) involved. 

  • If a breach of contract occurs, legal action will be pursued. The buyer agrees to pay all legal fees, including Davenport Hollow's attorney fees. 

  • In the event of a dispute, both parties agree to attempt mediation before pursuing litigation. If mediation fails, disputes shall be resolved by binding arbitration under the rule of law in accordance with the State of South Carolina. 

  • Any disputes arising under this contract shall be resolved in the courts of Orangeburg County, South Carolina. 

 

In any dispute arising from this agreement, the prevailing party shall be entitled to recover reasonable attorney's fess and costs. This agreement remains binding even in the case of unforeseen circumstances (natural disasters, disease outbreaks, government restrictions, or transport delays).

The buyer also agrees Davenport Hollow may photograph or video the animal at pick up or handoff to document condition. 

 

Strict Enforcement & Governing Law

 

These policies are strictly enforced. Exceptions will not be made, ensuring fairness and consistency for all clients. All transactions and agreements are governed under the laws of Orangeburg County, South Carolina. Davenport Hollow reserves the right to update this policy at any time, with or without notice.
